Amelias resa till Europaparlamentet

Jag har, vid sidan om mitt jobb för Amelia, fått i uppdrag att leda hennes omvalskampanj till europaparlamentet nästa år. Jag kommer därför vara tjänstledig från mitt jobb här i Bryssel under stora delar av våren för att istället kunna ägna mig åt valrörelsen hemma i Sverige. Målet är givetvis att Piratpartiet ska öka sitt resultat från 2009 och att bägge våra parlamentariker ska bli omvalda. Gärna att vi snor till oss även ett tredje mandat, vilket dock inte verkar allt för sannolikt. Just nu pågår i piratpartiet en medlemsomröstning om vår EU-lista inför nästa år och det är ingen hemlighet att jag gjort vad jag kan för att uppmana folk att sätta Amelia överst på vår lista. Det här inlägget är ytterliggare ett steg i det arbetet, samt ett sätt att ge folk en bild av varför jag beslutat mig för att ägna all min fritid mellan nu och valet med att jobba för att få Amelia omvald. Den här texten gör inga försök att vara objektiv eller rättvis utan den utgår helt från min subjektiva upplevelse av Amelia som jag har fått under de sju år som jag har känt henne

Första mötet med amelia
Det sägs ofta att det är det första intrycket man får av någon som avgör hur man kommer att uppfatta personen. Det stämmer kanske för många, men min första träff med Amelia var allt annat än minnsevärd. Jag gick med i piratpartiet i april 2006 ungefär samtidigt som Amelia och jag blev ganska snabbt en av de mer aktiva i partiet inför riksdagsvalet det året. De första månaderna av mitt engagemang var jag valkretsledare för södra skånes valkrets men under sommaren flyttade jag upp till Uppsala, och fick istället rollen som nationell partiorganisatör i partiledningen. Ett uppdrag som jag behöll till januari 2009. Samtidigt som jag flyttade upp till Uppsala så flyttade Amelia ner från Uppsalatrakten till Lund. Så vi var aldrig aktiva i samma ort under den valrörelsen. Men jag träffade henne faktiskt en gång innan hon flyttade ner.

Det var mitt första piratmöte i Uppsala, bara några dagar efter att jag hade flyttat upp. Den dåvarande valkretsledaren Mårten Fjällström hade kallat till ett möte på Cafe Linné och jag kom dit som en total främling. Ett tiotal pirater hade samlats på ovanvåningen. Sällskapet var ganska typiskt för hur pirater såg ut på den tiden, datanördar i olika former och storlekar, en och annan alternativ figur i Svarta kläder och udda frisyrer, och i en hörna satt en ung tjej i svart skinnrock och såg sur ut. Hon sade vad jag märkte inte ett ord på hela mötet, och jag tror inte ens att vi utväxlade en blick med varandra. Faktum är att jag nog inte ens kommit ihåg henne om det inte på den tiden varit ännu mer ovanligt med kvinnliga pirater än det är nu. Eftersom det var enda gången hon var på samma möte som mig tappade jag snabbt bort henne ur minnet. Ända tills jag mer än ett halvår senare skulle träffa henne igen i ett helt annat sammanhang.

Ung Pirat
Direkt efter valet 2006 fick jag i uppdrag av vår dåvarande partiledare att bilda förbundet Ung Pirat och styra upp så att det blev en godkänd organisation av Ungdomsstyrelsen. Jag skred ganska snabbt till verket och i december 2006 hade organisationen bildats och en första styrelse valts. Den styrelsen var dock mindre än vad stadgarna föreskrev, och under början av 2007 satte jag därför igång att dammsuga partiet efter framstående unga pirater. Det naturliga stället att leta på var partiets forum som på den tiden var själva ryggraden i partiet och utmaningen låg främst i att övertyga folk om att de skulle lägga tid och energi på ett projekt med väldigt oklar chans att lyckas. Men jag har alltid varit bra på att få folk att se min sida av saken, så jag skred till verket med gott mod. En av de forumanvändare som stack ut på den tiden var signaturen TeirdeZ och efter att ha tagit fram min mest övertygande sida kontaktade jag henne och föreslog att hon skulle sitta i förbundsstyrelsen för Ung Pirat. Svaret jag fick kunde sammanfattas till ett kort "tack, men nej tack" Hon kände sig inte bekväm med att ta på sig den typen av ansvar. Nu är jag inte den som ger upp i första taget, så efter visst lirkande hade jag övertygat henne om att posten som femte suppleant i förbundsstyrelsen inte skulle innebära särskilt mycket ansvar och på så sätt fått henne att tacka ja.

TeirdeZ, som visade sig heta Amelia Andersdotter, valdes in som suppleant i styrelsen på Ung Pirats första förbundskongress sommaren 2007, och hon var efter det en av de mest aktiva i styrelsen fram till att hon lämnade den på våren 2009 för att fokusera på EU-valet. Hon skapade och fick rollen som förbundets Internationella ansvariga, hon inledde vårt samarbete med Forum Syd, åkte som ungdomsrepresentant för Sverige till World Urban Forum, följde med Ung Pirats första delegation till Almedalen och hon och jag åkte med LSU på en utbildning till Bryssel. Det var på den resan jag verkligen upptäckte hur extremt vass hon var i sin argumentation, och vilken övermänsklig kapacitet till inlärning hon besatt. En förmåga hon allt som oftast själv förnekar. Samtidigt fortsatte hon bedriva lokal verksamhet nere i Skåne.

EU-listan
Det är kanske inte så lätt för nya medlemmar att sätta sig in i hur vi tänkte i partiet före EU-valet 2009. Men om man ska förstå hur vi beslöt oss för listan till det valet så måste man veta att vi när vi började diskutera listan inte trodde att vi hade särskilt stor chans att komma in i EU-parlamentet 2009. Vår ursprungliga plan var istället att använda EU-valet som ett övningsval inför riksdagsvalet 2010 och det var inte förrän vi började närma oss själva EU-valet som vi faktiskt insåg för oss själva att vi nog skulle komma in. Och då var vår lista redan satt. Just detta att listan sattes under en tid då vi inte såg våra chanser att komma in som alltför stora gjorde att det var förhållandevis enkelt att samsas om listans utformning och framtagande. Det utsågs en ad hoc-valberedning som utifrån vissa direktiv från styrelsen fick ta fram ett förslag som sedan godkändes. Ett av dessa direktiven var att översta platsen skulle vikas av vår vice partiledare, Christian Engström, som alltså utsågs av styrelsen att toppa listan. Ett annat direktiv från styrelsen var att listan skulle vara könsmässigt varvad så gott det gick, och att den skulle ha en tonvikt på yngre kandidater. När namn började diskuteras kom således forumnicket TeirdeZ väldigt snabbt fram som kandidat, och jag var en av många att lyfta henne som ett utmärkt förslag till andraplatsen. Eftersom andraplatsen mest var tänkt som en dekorativ plats passade hennes profil som ung alternativ tjej utmärkt som kontrast till Christians medelålders/medelsvensson-framtoning. Att hon hade en bakgrund i och stöd hos Ung PIrat gjorde inte saken sämre.

Min egen kandidatur
Det var aldrig någon tvekan om att jag själv skulle hamna högt upp på partiets lista inför EU-valet. Jag hade tidigt gått ut med mitt intresse för att vara med på listan, och jämfört med de flesta andra potentiella kandidater hade jag en profil som kunde tilltala andra än partiets kärnväljare. Jag hade även ett starkt stöd från vår partiledare och jag var en av få aktiva som signalerat att jag hellre jobbade i Bryssel än i Stockholm. Så jag placerades som nummer tre på listan, och ingick tillsammans med Christian och Amelia därför i den trio som fick använda sig av lite av partiets begränsade resurser för att åka runt och kampanja under valrörelsen. Eftersom Christian mest höll sig i Stockholmstrakten för att försöka synas i riksmedia blev det i praktiken främst jag och Amelia som åkte runt och kampanjade lokalt under valrörelsen. Återigen imponerades jag av hennes oförtröttliga arbetsinsats i att flänga land och rike runt för att tala på torgmöten och dela ut flyers med de lokala piraterna, oavsett hur liten ort det var som ville ha henne där.

Valet
EU-valet 2009 var en nästan surrealistisk upplevelse för många av oss. Jag tror att alla vi som var aktiva i Piratpartiet då har minnen från kampanjen som vi bär med oss. Men även om jag är väldigt nöjd med mina insatser så var det tydligt en av våra kandidater som stack ut. Amelia lyckades i ett flertal olika debatter totalt köra över betydligt äldre och erfarnare politiker genom sin enorma faktakoll och kompromisslösa stil.

När röken skingrats och rösterna räknats hade denna fram tills nu förhållandevis okända kandidat dragit in drygt tjugotvåtusen personkryss, lite mer än hälften av vad vår vice partiledare och förstaplatskandidat fått. Det var dubbelt så mycket som vår partiledare fick och nästan tre gånger så många röster som jag fick. Amelia hade genom valrörelsen blivit en legend, och hennes udda personlighet kunde utan tvekan tillskrivas en stor del av vårt totala resultat. Men hon hade samtidigt personligen hamnat i Limbo på grund av valresultatet.

Lissabonfördraget
Det är egentligen ganska ironiskt att piratpartiet, som motsatt sig Lissabonfördraget, skulle vara en av två svenska partier att gynnas av fördraget. Sverige fick genom fördraget två extra mandat i Europaparlamentet och ett av dem tillföll piratpartiet och gjorde Amelia till parlamentets yngsta parlamentariker. Problemet var enbart att fördraget gått igenom efter att EU-valet avslutats och att man därför behövde skriva om övergångsreglerna i fördraget för att de extra mandaten skulle kunna besättas. Detta visade sig vara en lång och snårig process och det skulle dröja över två år inann hon faktiskt fick tillträda.

De övriga parlamentarikerna som tillträdde via Lissabonfördraget ägnade de två åren åt att fortsätta sina tidigare liv hemma. Amelia däremot bestämde sig för att hon behövde vara förberedd på sitt tillträde och tog och utsåg tidigt mig till sin kanslichef. Sen tog hon och jag våra prylar och flyttade ner till Bryssel på vinst och förlust för att förbereda oss på dagen hon skulle tillträda som parlamentariker på riktigt. Jag var tvungen av ekonomiska skäl att flytta hem igen efter ett år, men Amelia fick efter ett halvår en betald praktik av den gröna gruppen i parlamentet, och efter två år beslöt sig vår kollega Christian Engström att anställa henne för att säkerställa att hon skulle kunna finnas kvar i Bryssel fram till att hon tillträdde. Men merparten av de två och en halv åren det tog tills hon kunde tillträda levde hon på lån och stöd från pirater som såg värdet i att ha henne i Bryssel.

Tillträdet
I slutet av oktober 2011 fick vi veta att det snart kunde vara dags för Amelia att tillträda som parlamentariker och i slutet av November fick vi veta att hon skulle tillträda i december. Jag hade redan i oktober sagt upp mig från mitt tillfälliga jobb i Uppsala och flög ned på direkten till Bryssel. Amelia var vid tillfället i rumänien och mötte därför upp i Strasbourg i samband med det plenarsammanträde där i mitten av december som blev hennes formella inträde i parlamentet. Halva mandatperioden var redan över, och det var nog ingen som trodde att parlamentets nyaste och yngsta parlamentariker från ett litet parti i ett litet land skulle hinna sätta några avtryck innan resten av mandatperioden var över.

De hade väldigt väldigt fel. På två år har Amelia presterat mer än de flesta hinner med på en hel mandatperiod. Hon började med att sänka ACTA och fortsatte med att lägga grunden för ett partiöverskridande stöd för en upphovsrättsreform under nästa mandatperiod. Samt gjorde intryck på världskartan genom sitt öppningsanförande på internet Governance Forum i Baku 2012. Det är inte så konstigt att både aktivister och vårt ungdomsförbund så väl som internationella pirater och folk utanför partiet alla ser henne som den utan tvekan starkaste kandidaten vi har. Jag kan inte ens föreställa mig hur mycket hon kommer hinna uträtta om hon får en hel mandatperiod till att verka i Bryssel, men jag vet att jag är beredd att göra allt jag kan för att ge henne chansen!

IGF 2013 närmar sig

Jag har alltid varit en smula avundsjuk på min chef för alla de internetkonferenser som hon blir inbjuden till runtom i världen. Så när hon föreslog att jag skulle följa med till årets upplaga av Internet Governance Forum var jag inte sen att instämma i att det var en mycket bra idé. Att årets konferens skulle hållas på Bali gjorde inte mitt intresse mindre.

Årets konferens är den åttonde konferensen sedan FN instiftade evenemanget år 2006. IGF är ett internationellt dialogforum för internet policy som sammanför olika aktörer i den multi-stakeholder-modell som reglerar nätet. Även om konferensen inte har något beslutsmandat är det utan tvekan en av de viktigaste mötesplatserna för att stämma av hur utvecklingen av nätet kommer gå de kommande åren. Detta är andra gången Amelia deltar på IGF. Förra året var hon en av öppningstalarna och fick en hel del uppskattning och uppmärksamhet runtom på nätet för sitt framförande. Framförallt hennes parafrasering på George Michael verkade fastna hos många:

Men det var då och nu är nu. I år kommer Amelia inte hålla något öppningsanförande, men däremot kommer hon medverka i en panel om Cyberspace Governance som anordnas av KAIST och modereras av internetpionjären Kilnam Chon.

A visit in Prague

sometimes you feel that you just need to change scenery for a few days. I had that feeling some weeks ago and asked Amelia if I could take a few days of and visit Prague. Amelia, always quick to see possibilities, gladly accepted under the condition that I meet with the Czech Pirates while there and briefed them on the current Data Protection Regulation that we work with in the Parliament (and in cooperation with civil society).

Said and done I contacted the Czech Pirates and found out that my planned trip overlapped with their four year birthday celebration. So there would already be a big pirate gathering on the Friday during my stay in Prague which could easily be merged with a discussion on Data Protection.

After two days of leisure I headed over to the tea house where the Czech pirates hosted their gathering. Arriving a quarter past four, fifteen minutes after scheduled time, I found myself early. But that gave me time to share some words with the independent Czech senator Libor Michálek, who got elected into the Czech Senate supported by the Pirates, the Greens and the Christian Democrats in 2012. As an independent senator he still keeps a good contact with the pirates who got him elected.

Some time after five I got around to have a short presentation of the current conflicts within the Data protection regulation, and also got around to show the campaign sites that civil society as well as the Swedish and Romanian pirates have up and running. After that the conversation turned towards how the Czech pirates could help raise awareness of the topic and what we could do to give them the information they needed to participate in a campaign for stronger data protection. Overall it was a very fruitful discussion and I have strong confidence that when we have our Czech intern Petr Kopač starting working with us in Brussels next week we will be able to set up a Czech campaign site in no time whatsoever.

After business comes pleasure, in the form of a big chocolate birthday cake with the Pirate Party logo in the frosting. I also got to present our office birthday present to the Czech pirates, two #Exile6e posters:

Upgraded!

As you might know the entire European parliament (and council and commission) are stuck with Microsoft products for all clients. We have Linux for servers and such that the tech people tinker with, but us regular office drones have the pleasure of everyday being greeted by the Microsoft logo. The majority here in the parliament are stuck with Windows XP as their daily software diet. But not us, we have been upgraded! We had the fortune of being picked to be part of the testing group for windows 7. And here's my review of the experience so far.

Overall impression
So what's the big difference for a user when you log in? Desktop looks more or less the same, things function more or less the same as before. Nothing much has actually changed from the XP experience. Only difference is that the programs that comes with the package has been upgraded. Perhaps the start-up time is slightly shorter, but if so it is a marginal difference.

Web browser
This is probably the biggest change. In the XP environment of old we were all stuck with Internet Explorer and not allowed to add other browsers to the computer. But now in our new Windows 7 home we got Firefox installed from start. Personally I circumvented the old lock-in to IE by using Firefox portable, but now I can have the full foxed out browsing experience without any hassle. So a huge plus for this.

Mail
I have no clue what version of Microsoft Outlook was part of the old package, but upgrading to Outlook 2010 has been a blessing. No more random freezes of the program when you try to search through a large folder, a better team layout for the schedule and an overall much neater appearance. Only minus is that I don't like the new system of archiving emails that I need to keep (a necessity since the system automatically erases all emails not archived after three months) and also some buttons seems hard to find in the new layout. But all in all, a huge plus for upgrading the Outlook.

Office suite
I mainly use the Word and Excel tools of the office suite, and none of them have improved by the upgrade. Unintuitive menus and a huge increase in clicks to do anything is making the use of Word & Excel 2010 a pain to say the least. A huge minus for this.

Summary
I feel very lucky to be one of the privileged few to be included in the test group for Windows 7 and all the upgraded tools it brings. I would have felt even better if it had been in a free and open environment where I could choose any operation system I prefer, but if I'm going to be forced to use something that others have chosen for me it is definitely better to have something a little more up to date.

To use the post ACTA momentum

With the fall of ACTA this spring those of us who want an open online environment have an opportunity to move forward our positions towards those that want to overly regulate the flow of communication online. One way of doing that is by constantly reminding people of what exactly was wrong with ACTA and why no similar legislation should be allowed to infest other trade agreements currently being negotiated by the commission.We should not let ACTA be seen as a single case of success, but rather as the turning point on how Europe conduct trade agreements with other parties.

Three Polish MEPs (ZALEWSKI, HANDZLIK & WAŁĘSA) moved in that direction after the ACTA vote by putting the following question to the commission:

Last week, Parliament rejected the ACTA agreement by a huge majority, thus sending out a very clear ‘no go’ signal regarding any such regulatory legislation.

In the short time that has passed since, we have already been alarmed by the prospect that several significant and heavily criticised parts of the ACTA agreement (i.e. general obligations on enforcement, damages, criminal sanctions, intermediary liability rules and border measures) are expected to ‘live on’ by being incorporated into CETA (the Canada/EU trade agreement) and, possibly, into other international agreements which the Commission plans to conclude in the near future.

Since we are absolutely convinced that the Commission fully respects the position of Parliament and would not indulge in any type of legislative exercise that would undermine the voice of the citizens, as transmitted to and expressed by Parliament, can the Commission comment on this issue and allay the worrying doubts indicated above?

Now the answer has come back and from the wording it is clear that our victory regarding ACTA has made it more difficult for those who want to infest international trade agreements with overly harsh chapters on IPR. That will, of course, not stop them from trying.

The commissions reply to the question above is as follows:

1. As with all of the EU's bilateral trade agreements, the Canada-EU Trade Agreement (CETA) will contain a chapter on intellectual property (IPR). This is important because the EU and Canada are knowledge-based economies requiring an effective regime to protect their intellectual assets. For this reason, the EU is proposing rules to address several important issues that have been identified in Canada's IPR regime, namely in the area of copyright, patents, geographical indications and enforcement. However, the IPR chapter of CETA will not require the EU to modify its existing legislation, and great care is being taken to ensure that it is compatible with the EU acquis.

2. The CETA negotiations have not been concluded. Recent media reports relied upon a version of the negotiating text which is 6 months old to claim that the Commission is introducing ACTA through the back-door . That text stems from a time when ACTA had just been signed by the EU and 22 Member States and before the European Parliament denied its consent. As both the EU and Canada were in the process of ratifying ACTA at that time, it is not surprising that some provisions of that version used formulations also found in ACTA. Negotiations have now moved on and the February text no longer accurately represents the state of play.

3. The Commission fully respects the vote of the European Parliament. It develops its negotiating positions to ensure that they are coherent with EU policy. The IPR chapter of CETA is currently being reviewed in light of the position expressed by the European Parliament on ACTA and the Commission will continue to fully and rapidly inform the EP's INTA committee about progress in the negotiations.

Access to Medical Research Data

There ain't no such thing as a free lunch. Not even in the European Parliament. But more often than not you can pay with your time instead of money here in the parliament. The concept is easy: You get to eat, and the lobbyist get to lobby you while you're eating. If you choose wisely you'll not only get the lunch paid for you but you'll also end up spending your time being lobbied by the lobbyists you like. Perhaps even gain some insight or knowledge you didn't have before or make some connections that can come in handy in the future.

I spent my lunch today being lobbied by Health Action International Europe and Trans Atlantic Consumer Dialogue. In my book they're among the good lobbyists here in the parliament, and today they where holding a lunch debate on the topic "opening up medical research data for an ethical and efficient EU policy", graciously hosted by three MEPs: Christel Schaldemose (S&D), Peter Liese (EPP) and Margrete Auken (Greens/EFA).

HAI summarize the problem they aim to tackle in the following questions on their webpage:

Crucial information about many medicines is kept secret. In consequence, doctors can face difficulty in choosing the safest and most effective treatment for their patients. Is it ethical and efficient for the EU to allow essential medical research data to be shrouded in secrecy? Can the health of EU citizens be effectively protected with very little or insufficient access to clinical trial data concerning the safety and secondary effects of a drug?

During the lunch I was particularly impressed by the speech and remarks from Prof. Dr. Peter Gøtzsche who's position on the topic can be found here. From a Pirate perspective there's no doubt about the fact that the movement for access to Medical research- and health trial data is one more branch of the growing movement for an open and transparent society.

Green Group briefing on Data Protection

One of the main perks of being part of a political group within the European Parliament is the access to a group of informed policy advisers that keeps tracks on all the dossiers that float around in the system. Below I would like to share some parts from a briefing document on Data Protection that was sent to the Green group some days ago.

Background

In accordance with article 8 of the EU Charter the Right to personal data protection:

1. Everyone has the right to the protection of personal data concerning him or her.

2. Such data must be processed fairly for specified purposes and on the basis of the consent of the person concerned or some other legitimate basis laid down by law. Everyone has the right of access to data which has been collected concerning him or her, and the right to have it rectified

3. Compliance with these rules shall be subject to control by an independent authority.

Since the adoption of Directive 95/46 on the protection of individuals with regard to the processing of personal data and on the free movement of such data a lot has changed in the area of data protection, notably technological developments, increased collection and processing of personal data for law enforcement purposes with a patchwork of applicable data protection rules and globalization of markets and cooperation. Furthermore the directive has failed to achieve a proper harmonisation due to the different implementation of its provisions in the Member States. In this context it has become increasingly difficult for individuals (‘data subjects’) to exercise their right to data protection. This problem is particularly visible as regards social networking sites like Facebook and surveillance measures like the use of telecommunication data (Data retention) and Passenger Name Records for law enforcement purposes. Furthermore it has hampered the development of the Single Market with companies (controlling or processing personal data, ‘data controllers’) and consumers facing differences in data protection requirements. There is also a concern regarding the protection in particular sectors, such as employment

Since the entry into force of the Lisbon Treaty the Union has an explicit legal basis for data protection covering processing of personal data in the public and private sector but also in the context of law enforcement (resulting from the collapse of the pre Lisbon “pillar structure”). The Commission has now used this legal (article 16 (2) TFEU) to present proposals for a revision of the Union's data protection framework. It proposes a Regulation (COM (2012)11) that will replace Directive 95/46 and amend Directive 2002/58/EC on E-privacy and a Directive (COM(2012)10) that will replace Framework decision 2008/977/JHA on the protection of personal data processed for the purpose of prevention, detection, investigation or prosecution of criminal offences.

The fact that the Commission chose to replace Directive 95/46 with a (directly applicable) Regulation should reduce the fragmented approach to data protection among Member States. It did however choose to leave quite some room for Member States to maintain or adopt specific rules (e.g. regarding the public interest (article 21), freedom of expression, professional secrecy, health and employment (articles 80-85) and for the Commission to adopt delegated and implementing acts, such as on the threshold for a data breach notification.

Furthermore the Commission failed to deliver a comprehensive system of data protection as Parliament called for in the Resolution 2011/0323 adopted on 6 July 2011. The Regulation does not cover law enforcement cooperation (on which the separate Directive is proposed). Furthermore data protection rules for EU institutions and bodies based on Regulation 45/2001 are excluded from its scope. Processing by Europol and Eurojust and data processing within the context of Common Foreign and Security Policy are also excluded.

This leaves legal uncertainty as regards rights and obligation in borderline issues, for instance where commercial data is used for law enforcement purposes and transfers between authorities that are responsible for law enforcement and those that are not. Further clarification, for instance in article 21, is needed.

The proposed regulation will be applicable to EU and non-EU companies. It will therefore have an extra-territorial effect, meaning that it will apply to controllers that are not established in the EU but are active in the market of the EU by offering goods or services to data subjects residing in the EU or by monitoring their behaviour.

The Regulation clarifies and strengthens a number of data protection rights and principles in the light of technological changes and globalization.

The inclusion of a transparency requirement (articles 11, 14) leads to stricter obligations to inform data subjects. It is also specified that accordance with the principle of data minimization the collection of and processing personal data should be limited to a minimum. Furthermore the data controller has to demonstrate compliance with the Regulation. The principle that data should be limited for a specific purpose and must not be further processed in a way incompatible with the purposes for which they have been collected.

The requirements for obtaining consent of the data subject for data collection and processing are clarified (article 7). Consent has to be given explicitly (‘opt-in’). For children under the age of 13 the parent’s consent is explicitly required before data collection and storage is allowed.

The right of access is strengthened by imposing deadlines and the duty to motivate a refusal to grant access. Furthermore the right to erasure has been strengthened into a ‘right to be forgotten’ (article 17). Data subjects will be able to demand that the data controllers take all reasonable steps to ensure deletion of their data if there are no legitimate grounds for retaining them and especially where those data have been published and republished online. There has been some controversy around this provision, particularly as regards its enforceability, the relationships with the freedom of expression and burdens on business.

In addition a right to data portability is introduced (article 18). This right is designed to facilitate an individual's access to personal data and ensure that people will be able to transfer personal data from one service provider to another more easily.

There is a fear that the rules on profiling will be difficult to understand and apply in practice. The regulation only imposes limits on automated processing of personal data (article 20), which results in decisions adversely affecting the person or are based on sensitive data. This ensures that human intervention remains necessary. It does however not prohibit the sorting of people based on profiles as such.

An important element of the proposal is a shift from notification requirements to the data protection authorities to practical compliance and individual empowerment (article 22). The regulation furthermore introduces the obligation to keep documentation of all processing operations (article 28), to notify security breaches (articles 31,32) and to perform a data protection impact assessment (article 33).

The proposed Regulation sets out obligations of the controller arising from the principles of privacy by design and by default (article 23 (1) and (2) respectively). “Privacy by design” means that data protection safeguards should be built into products and services from the earliest stage of development. “Privacy by default” means that the default setting should be those that provide the most privacy.

The article on data protection by design and default is important to ensure that for instance the privacy settings of social networking platform allow the data subject the choice to opt for more intrusive use of its personal data then strictly necessary for the simple use of it.

The security breach notification builds on article 4(3) of the E-privacy directive. If data is accidentally or unlawfully destroyed, lost, altered, accessed by or disclosed to unauthorised persons, organisations will have to notify both individuals and the relevant supervisory authority, where feasible within 24 hours. It will have to be debated how realistic the 24 hour threshold is.

In accordance with article 35 of the proposal data controllers or processors with more than 250 employees or whose core business it is to process personal data will have to appoint a data protection officer to monitor internal compliance with the regulation. The benchmark of 250 employees has been criticised for being either to high (effectiveness) or too low (costs). It is unclear whether the number of employees is the right standard to be applied.

The provisions relating to the third country data transfers are modified compared to the existing rules. As an example, the current prohibition of any transfer to countries that are not deemed adequate is replaced by a general principle that transfers can take place only if the conditions for transfers set fourth in the proposal are met. As hitherto, the Commission’s power to adopt decisions recognising the adequacy or the non-adequacy of a third country, will be maintained, but will now also involve international organisations and sectors. In the absence of an adequacy decision, the controller or processor should take appropriate safeguards measures such as binding corporate rules, standard data protection clauses adopted by the Commission or by a supervisory authority.

The proposed Regulation implements a “one-stop-shop” approach to data protection compliance in the EU (article 51). The new competence as lead authority in case that a controller or processor is established in several Member States will ensure unity of application. The one-stop-shop will apply to organisations as well as to data subjects. Organisations will only have to deal with a single national data protection authority in the EU country where they have their main establishment. A data subject will be able to refer to the data protection authority in their country, even when their data is processed outside their home country.

The independence and the powers of supervisory authorities will be strengthened as regards investigative powers and sanctions. They will be able to impose fines of up to 1 Million Euro or 2% of global annual turnover of a company for violation of data protection rules. They will furthermore receive enhanced funding.

Cooperation between DPAs will also be strengthened in the context of a European Data Protection Board (which is to replace the current "article 29 Working Party"). The Board will consist of a head of a supervisory authority of each Member State and of the European Data Protection Supervisor.

EP must move forward and torpedo ACTA once and for all

The European Parliament's trade committee, the lead committee in the ratification process for the controversial Anti-counterfeiting Trade Agreement (ACTA), will today debate ACTA and the recommendation by the EP rapporteur to reject the agreement. The debate comes a day after the EU's data protection supervisor raised concerns with ACTA (full report found here) and ahead of the vote in the EP trade committee, which is now scheduled for the end of May.

The Greens/EFA group has opposed ACTA since the outset, highlighting concerns about the fundamental rights, internet freedom, freedom of establishment and access to medicines, as well as the sweeping approach to intellectual property enforcement. The group is clearly in favour of rejecting ACTA and underlined its support for the recommendation by the rapporteur, with Swedish MEP Amelia Andersdotter (Pirate Party) stating:

"We welcome the recommendation to reject ACTA. The agreement should never have been concluded in the first place given the serious concerns about its one-size-fits all approach to IP enforcement, its potentially far-reaching provisions and the shadowy negotiation process. The EP must now move swiftly forward with the ratification process and torpedo ACTA once and for all. The next key step in this process will be the trade committee's vote at the end of May and we urge MEPs from all groups to vote against the agreement.

"Yesterday, the EU's data protection supervisor became the latest in a long line of experts, legal analysts and stakeholders to raise concerns with ACTA. In addition to concerns about data protection and internet freedom, there are widespread concerns about the potentially far-reaching implications of ACTA on fundamental rights, freedom of establishment and access to vital medicines. At EU-level, ACTA would block the much-needed reform of EU copyright law and instead lead to a heavy-handed and repressive enforcement of copyright with no regard to either the basic rights of citizens or the needs of European digital entrepreneurs.

"For these and other reasons, the Greens believe ACTA as it stands should be scrapped. Intellectual property enforcement cannot entail a sweeping approach, instead there is a need to assess the different challenges facing different economic sectors and different aspects of intellectual property and develop individual solutions for these sectors."

Den här veckan i Strasbourg började en dag senare än vanligt för att ta hänsyn till den ortodoxa påsken. För verksamheten här betyder det inte mycket mer än att allt är flyttat en dag framåt och att veckan slutar på fredag eftermiddag istället för på torsdag.

Men trots det rubbas rytmen av att allt inte är som sig brukar. Själv kom jag av mig med att posta veckans möten för Amelia, som jag normalt försöker posta på måndagskvällen. Tanken var att det här inlägget skulle ha skrivits igår, men nu får ni ha överseende med att det kommer upp idag istället.
