Carl Bildt borde arbeta för svenskar, inte för amerikaner

För sex dagar sedan förkunnade Carl Bildt att han och hans tjänstemän utgår ifrån att de är avlyssnade i DN. Det må så vara att Utrikesdepartementet inte har någonting emot att bli avlyssnade av tredje makts säkerhetstjänster, men vi som är svenskar och lyder under Utrikesdepartementet förväntar oss med stor sannolikhet att de ska skydda oss från tredje makt. Carl Bildt och hans tjänstemän får gärna underkasta sig avlyssning så länge de samtidigt säkerställer sig om att vi andra inte blir det.

En sådan skarpsinnig analys av sitt uppdrag har dock Bildt själv inte dragit. Han har tillsammans med brittiska regeringen istället enligt uppgift blockerat ett förhindrande av handelsförhandlingar med USA, som bland annat kommer att röra just övervakning av elektronisk kommunikation i och med sitt kapitel om elektroniska tjänster.

Det är tyvärr symptomatisk för svensk mediabild och för svensk politik: i PRISM-skandalens första skede var människor både arga och upprörda över att amerikanska företag underkastas sig amerikansk militär och följer amerikansk lag (vilket ju egentligen är helt rimligt), samt att amerikansk demokrati inte fungerar (vilket den naturligtvis gör, eftersom den amerikanska demokratin och konstitutionen naturligtvis skyddar amerikanska medborgare, inte svenska). Det som är så tragiskt är att våra egna politiker inte skyddar oss från amerikansk säkerhetstjänst. Det faller på sin egen orimlighet att Carl Bildt, Allan Widman, Birgitta Ohlson, Cecilia Malmström eller Fredrik Reinfeldt skulle sätta amerikanska säkerhetstjänstens intressen framför sina egna medborgares.

Ändå är det precis det som händer.

Under Almedalsveckan deltog jag i två seminarier om EU:s dataskyddsförordning och personuppgiftsskydd i Sverige. Under båda seminarierna tog jag upp den ganska svåra frågan om maktbalans: varför förutsätter våra makthavare att det är vi, medborgarna, som är de onda som ska granskas, samtidigt som de misslyckas totalt med att skapa transparens i sina egna processer?

Frågan har inte fått något ordentligt svar, men mest talande om ointresset för frågan bland befintliga makthavare, både politiska och tekniska, är nog Patrik Fältströms uttalande att han tycker det är viktigt och relevant att den här frågan diskuteras när det inte är valår - han tycker nämligen inte att maktdistributionsfrågan är tillräckligt politiskt viktig för att diskuteras i den demokratiska process när medborgarna väljer vem som ska ha makt.

Underligt, kan tyckas. Spårning och övervakning kan leda till väldigt godtyckliga konsekvenser i maktutövande: människor kan bli rädda för att söka sjukvård om de inte kan göra det anonymt. De kan tappa förtroende för statliga eller kommunala och regionala tjänster som de inte har juridisk eller praktiskt rätt eller möjlighet att undvika. Människor i den offentliga förvaltningen som vill göra ett bra jobb blir också lidande eftersom de vet att de inte kan hjälpa att understryka och bekräfta medborgarnas oro. Vi blir rädda för att uttrycka vår mening, gentemot både privata och statliga aktörer. Vi blir rädda för att vårt beteende ska leda till olyckliga konsekvenser i vårt privatliv - vi har inget sett att garantera att en människa med helt goda avsikter gentemot någon annan, gör våra egna liv mycket svårare i sina försök att hjälpa sin egen vän. De som övervakar och de som har kunskap blir en överklass i samhället, som man gör bäst i att hålla sig på god fot med eller lida godtyckets risk. Saker tagna ur sitt sammanhang blir plötsligt väggen mellan medborgaren och jobbet, myndigheten och medborgaren (bygglov, t ex) eller medborgaren och dess vänner. Det är den maktöverföringen som har skett i rättsväsendet senaste åren, i polisväsendet, åklagarväsendet, till privata aktörer och säkerhetsbolag, mot FRA och i förhållande till staten. Olyckligtvis har varken vår utrikesminister eller näringsministerns tekniska rådgivare uppfattningen om att det här är ett problem. Och det är klart att varken tekniska rådgivare med makt, eller utrikesministrar med makt, har ett intresse av att under valår diskutera frågor som i slutändan innebär att de själva ser sämre ut inför medborgarna eller att de och deras vänner får mindre inflytande och makt över alla andra.

Jag väljer att hålla mig lite utanför diskussionerna om datalagringsdirektivet, som ju ändå i vilket fall bordlags ett år nu. Det känns som FRA 2008! Ja!

I Europakommissionen tycker kommissionären för den inre marknaden herr Michel Barnier inte att blinda ska få läsa. Världsorganisationen för blinda har tillsammans med Knowledge Ecology International och Trans-Atlantic Consumer Dialogue arbetat i flera år, i Geneve, i Bryssel och i Washington för att få till ett avtal om undantag i licensrätterna för blinda så att tillgängligheten för böcker anpassade för synskadade ska bli mer lättillgängliga. USA och EU har vägrat i sten, gruppen av afrikanska länder i WIPO har varit skeptiska eftersom de tycker att undantagen borde utsträckas till alla former av licenser, och den 26 februari har så Världsorganisationen för blinda slutligen dragit sig ur diskussionerna efter de inte kommer någon vart.

Europaparlamentet har visserligen försökt gå till kamp för blindas rättigheter. David Hammerstein från TACD har arbetat länge med avtalet och anordnat flera konferenser om vikten av tillgång till böcker för blinda. Världsorganisationen för blinda säger att de kommer att fortsätta kämpa för ett avtal som stödjer deras medlemmars rätt till kultur.

Det är lite deprimerande, hela det här boktillgänglighetsprojektet. En man vid namn Mopski [sic!] anser att Google i sin digitalisering av världskulturen inte tar vara på visuella artisters intressen. Vidare är Googles digitaliseringsprojekt inte uppskattat i Frankrike.

Men, materialet går i alla fall att få tag på. Jag läste någonstans, någon gång, att blinda i Uruguay har totalt 19 böcker de kan läsa. I Nicaragua har de 48 böcker. Att dela med sig av böckerna över nationsgränserna går inte för då får man licenseringsproblem. Vill minnas att Norge inte var lika dogmatiska som Europeiska unionen, och EU var i sin tur inte lika dogmatiska som USA. Många länder lät bli att stödja Treaty for the Blind av principskäl för de tycker de har väldigt stora problem med upphovsrätt överlag och behöver bredare undantag. Det är förvisso sant, men det ska man inte använda som skäl att missgynna blinda. BRIC-länderna har i alla fall inte ställt sig helt ogina till avtalet, vilket alltid är nåt, men de är inte ensamma kapabla att driva igenom avtalet. Europaparlamentets ställningstagande kan förhoppningsvis leda till en förändring av EU:s ståndpunkt. Vi får se.

Korean Zombie PCs

The observant reader will have seen by now that these numbers boil down to 3.3 and 7.7, an observation also made by Korean openweb activist Keechang Kim.

Why would a worm herder kill off her worms? And why is there no political nor economic message attached to the attack? A surprise attack, like Hannibal and the elephants emerging from the mists of the Alps. Well. It's a second surprise attack and you would expect war elephants to work only once. In the case of anything involving computers this is not so. Virii, for instance, have made governments and computer users insecure since the dawn of time. I don't know what to make of the fear against Stuxnet, for instance. Technically the only thing it does is make a reactor unable to produce refined fissionable material for possible nuclear weapons. By attacking, as far as I understand, SCADA systems that are anyway not secured very well. Instead of securing SCADA systems, the fear makes governments want regulation. We think. Why?

A reader with good memory will have remembered by now that the French internet authority HADOPI last year suggested a universal piece of (open source) software installed on all French computers to help users determine whether they are in fact downloading copyrighted material or not. I guess you'd have to be pretty informed to know that there was a similar proposal in South Korea pursued happily by an ambitious government in 2009, called the Zombie PC Prevention Act. See, I am very concerned about the EU-South Korea FTA effects on European internet policies, and many Korean activists (most notably IPLeft) are similarly concerned about the US-South Korea FTA effects on Korean internet policies. But this is not a free trade agreement. It's an own-initiative report.

Popular support is rising for a helpful Zombie PC Act giving a government-controlled authority the mandate to access and scrutinize commercial, official and private datasystems. The authortity will help the government determine if the system is infected by any potential virus. Lacking appropriate anti-virus software shall, according to the bill, lead to repercussions.

Jag har skrivit rätt mycket om Sindelagen och Zapateroregeringens inställning till upphovsrätt under de senaste åtta åren. Igår hölls en omröstning i spanska senaten om hur processen ska fortskrida under våren. Det lyckades Piratpartiets internationella representanter äntligen lyckades uppmärksamma. Men snälla kom ihåg att parlamentet inte kommer att slutgiltigt godkänna lagen förrän om en månad!!!! Partido Popular, Spaniens konservativa parti, kan fortfarande väga upp Zapateros hejdukars internetcensur. Finns det hopp, finns det chans, men den utmålas som så liten att den vore ett mirakel. Vi får se hur Internautas ställer sig nu när det också ligger en anklagelse om att kulturministeriet är korrupt. Eller kanske Carl Bildt träder in för frihetens skull?

Samtidigt läser jag i veckans EDRi-gram att USA:s regering har beslutat dra in domännamnen för flera streamingsajter för sport från Spanien. Torrentfreak rapporterar mer om Superbowl-yran (själv tycker jag att brännboll är väldigt tråkigt och tittar hellre på All Blacks). Streamingsajter har jag bara nämnt i förifarten och lovat mig själv att kolla upp närmare men de har förklarats lagliga i Spanien vid två tillfällen, verkar vara lagliga i Sverige och är tydligen också populära och lagliga i Israel.

Tillsammans med RapidShare och MegaUpload ses streaming som nästa stora hot mot upphovsrättsindustrin. Det går liksom lite över katt-och-råttalek när ansvar för upphovsrättsintrång flyttas från privatpersonen till tillhandahållaren av uppkopplingen och sedan till internetoperatören och slutligen domännamnsregistraren. En lista har i alla fall skapats om hur man tills vidare kan komma förbi amerikanska regeringens fortsatta ansträngningar.

I en kommentar till mig förra veckan anslogs att upphovsrättsindustrin i denna bemärkelse faktiskt är rätt så progressiv. De nöjer sig varken med ett status quo eller med ett bevarande av upphovsrätten så som den sett ut under 1900-talet. Snarare kan man se upphovsrätten som ett ständigt förändrande fenomen, vilket kanske tydligast åskådliggörs av 1930-talets plötsliga införande av näraliggande rättigheter och nutidens förflyttning av upphovsrättens innebörd från samhällelig konsensus till påtvingad moral.

I vilket fall fick jag efter Piratpartiets pressreleases om Sindelagen ur kontexten av Universals plötsliga katastrofala lidande frågan om hur Sindelagen kan komma att påverka svenskar. Egentligen gör den väl inte det just nu. Men Spanien blir det andra landet i ordningen som inför nedstängning av hemsidor, och det fjärde landet i ordningen där påtvingade självsaneringsregler för internetoperatörer blir norm. EDRi har om detta nyligen givit ut en sammanfattande skrift om farorna med självreglering.

Vad jag ser är en Michel Barnier vid rodret på DG Markt (kommissionens generaldirektorat för den inre marknaden) som lovar att skärpa reglerna kring upphovsrätt på internet. Karel de Gucht på generaldirektoratet för utrikeshandel har annonserat att ACTA är definitivt förenligt med EU:s lagstiftning. Jag ser en digital agenda som lägger tyngden på en inre marknad för digitala tjänster. Mina två orosmoln blir följdaktligen att Spaniens och Frankrikes regelverk kommer föreslås som norm och att "internet" begränsas till att för europeerna vara ett geografiskt begränsat fenomen. Den innebär i så fall att vi inte undkommer den regim som nu inrättats av USA och att vi därtill bara svårligen kan ta oss utanför det område vari regimen gäller. Jag ska lägga på minnet att Ung pirat måste svara på kommissionens nya konsultation.

Major protests broke out in Tunisia following the self-immolation of a student in late December. The demonstrators are protesting unemployment and government violence, and as opposed to a previous norm of protests from spontaneous worker unions the recent uprisal seem to engaged a much larger part of the population to participate. The unemployment protesters were joined by net activists causing an alarm around the extensive web filtering and repression of journalists, soon followed by international assistance from Anonymous groups and OP:Tunisia. Several government agencies have been DDoS:ed or had their webpages defaced.

The Tunisian dictatorship has responded with riot police and arrests starting late December 2010 with several arrests of lawyers.

In Europe the issue started getting media attention a few days ago. Reporting up until that point had been scarce but is now spreading through several international venues, especially in the European Union. In a response that might be related, late afternoon yesterday the dictatorship started arresting a large number of Tunisian information activists and journalists. While Tunisian bloggers have been subject to disappearances, arrests and torture in the past, actions against them have not previously been this large in scale.

About 20% of the Tunisian population are connected to the internet, a large part of whom have connections in their homes. The infrastructure and subscription fees are some of the lowest in Northern Africa.

Getting media coverage of the recent protests in Europe is good, but hardly sufficient. The European Union has an obligation under their own framework treaties to use trade as a tool for encouraging democratic development in foreign trade partners. In Northern Africa, this instrument has sadly been poorly used. France Telecom and Orange hold large stakes in the Tunisian telecommunications market. In a criticized France is ramping up their firearms exports to Khaddafi's dictatorship in Libya, but they are also since many years back one of the largest providers of firearms and other weapons to Tunisia. Unfortunately, the foreign trade policies of one of the largest economies in Europe, and a founder country of the European Union at that, makes it unlikely that the European Commission will take trade action against Tunisia.

My understanding of the European Commission is that the Directorate Generals responsible for human rights, justice or telecoms have limited influence when it comes to foreign trade and the policies that would put effective pressure on foreign regimes. Commissioner Karel de Gucht and President José Manuel Barroso may underestimate the impact they have on the human rights situation in third countries. Unfortunately, parliamentarians in Europe and member states have limited influence on those positions, and we may have to hope for European governments and Council of Ministers to take a stronger stand for human rights in other countries.

Sustainable Economy

Today I found an article in El País about sustainable democracy. Ignacio Sánchez-Cuenca, a sociology professor, suggests that liberalism is finally overtaking democracy, and that technocracy and economical interests will get their victory over the idea of equal participation for all citizens in the decision making processes for society.

For letting such well-made reasoning into their debate pages, El País appear to not have commented at all on the undemocratic processes around the approbation of the Sinde Act, or the Act of Sustainable Economy, that will likely be debated by a subcommittee in the Spanish senate on Monday, rather than going through parliamentary scrutiny. The reason is apparently that the parliament should not have to bother themselves with trivial matters when there are more important issues to discuss.

El País is loyal to PSOE. Ángeles González-Sinde is the Minister of Culture in the Zapatero cabinet. Zapatero is the Spanish president and chairman of PSOE.

Hidden deep in the bowels of text of the Sinde Act, among hundreds of articles on environmental sustainability, are a few articles on criminalization of file-sharing and file-sharing services. These new social phenomena have previously been declared compatible with Spanish law since anything else would be ridiculous, torrent trackers are just a socially accepted modern form of library, and you can anyway not be convicted for something you didn't actually come in touch with.

The Sinde Act will create space for copyright owners to harass Spanish citizens in the same way Americans, Swedish and British citizens have been harassed in the past. Or leave the door open for scammers to harass citizens, like in Germany. If someone thought a constitutional ruling could provide some kind of safe-guard, through being an expression of common norms or general agreement of the values society should uphold, apparently they are wrong.

If someone thought that the legislative institutions of Spain will debate issues against which 200'000 Spanish citizens have protested in an open and democratic manner, apparently they are wrong. 200'000 citizens is nothing. Only 0.05% of the total population. Trivial.

Spain was put on the US Trade Department 301-list in 2008 and have remained there until the 2010 edition. The Sinde Act, or a law that breaks a long-standing tradition of constitutional interpretation in Spain, is a response to this listing and Spanish government representatives have of course been in contact with the US ambassador to find out how to remedy this awkward postition. Since 1974 the 301-lists give the US the right to unilateral trade sanctions. The US is the only country in the world that upholds unilateral sanctions, that is, the US decides on its own to punish a displeasing country. Is that allowed? Technically not. But the World Trade Organisation has approved the practise as long as the sanctions are passed through an arbitration panel. Through the 301-lists the US has also upheld, to the irritation of the globalised free markets, uncomfortable levels of protectionism.

These protests, the government and senate must reason, are a sign of poor understanding of global trade, probably conducted by extremists with bandwidth, connectivity and a sense for free culture. Values otherwise not present in the Spanish system. And the rest of Europe is reacting about as strongly as they reacted to the French law recently adopted which allows for arbitrary, non-judicial internet censorship. And the suspicions of professor Sánchez-Cuencas appear to be coming true a lot sooner than he probably wanted. It is three days left until the Spanish democracy is confronted with its fate.

UPDATE: It's probably decent to say that there's senate and parliamentary resistence, right? :)

Hållbar ekonomi

Idag hittade jag en artikel i El País om hållbar demokrati. Sociologiprofessor Ignacio Sánchez-Cuenca menar att liberalismen kanske slutligen håller på att upprätta sin dominans över demokratin, att teknokratin och ekonomin får sin seger över alla individers lika rättigheter att delta i beslutsarenan.

För att släppa in så gedigna, demokratiska debattinlägg verkar El País inte ha gitt kommenterat på Sindelagen, eller lagen om hållbar ekonomi, som på måndag förväntas behandlas av en spansk underkommittée till senaten istället för att debatteras i parlamentet nästa år. Anledning är att beslutet är en petitess parlamentet inte ska belastas med då de har viktigare beslut att syssla med.

El País är en PSOE-lojal tidning. Ángeles González-Sinde är kulturminister i Zapateros regering. Zapatero är PSOE:s ordförande.

Dolt i lagens inre, bland hundratals artiklar om miljövänlig utveckling, gömmer sig kriminalisering av nedladdning och nedladdningstjänster. Dessa samhälleliga fenomen har tidigare förklarats lagliga i Spanien eftersom allt annat vore löjligt, att trackers möjliggör en socialt accepterad typ av bokutlåning och att man inte kan straffas för någonting man bara indirekt haft att göra med.

Sindelagen kommer att skapa utrymme för upphovsrättsägare att trakassera spanska invånare på samma sätt invånare trakasserats i USA, Sverige och Storbritannien. Eller så blir invånarna trakasserad av någon annan, som scammers i Tyskland (jfr Storbritannien). Om någon trodde att juridiken och rätten skulle upprätthålla samhälleliga normer och konsensus kring vilka spelregler som gäller i samhället har de tydligen fel.

Och trodde man att Spaniens lagstiftande institutioner debatterar frågor som 200.000 spanjorer protesterat mot på ett öppet och demokratiskt sätt, har de tydligen fel. 200.000 spanjorer är en petitess. Dryga 0.05% av den totala befolkningen. ··· ···

Spanien sattes upp på USA:s handelsdepartments 301-lista 2008 och har där förblivit även tills i 2010 års upplaga. Sindelagen, eller lagen som bryter mot domstolars tidigare tolkning av spanska konstitutionen, är ett svar på placeringen och spanska regeringsrepresentanter har givetvis varit i kontakt med amerikanska ambassaden för att diskutera hur det juridiska läget ska åtgärdas. 301-listan ger sedan 1974 USA rätt till unilaterala handelssanktioner. USA är det enda landet i världen som fortfarande upprätthåller maktutövande genom unilaterala aktioner, det vill säga att USA ensamt bestämmer sig för att straffa ett misshaglig land. Får man verkligen göra så här? Nej, egentligen inte. Men Världshandelsorganisationen har godkänt förfarandet så länge de unilaterala sanktionerna går via en konfliktlösningspanel. USA har på detta sätt också upprätthållit en för den globaliserade frihandeln besvärande protektionism.

Spanska regeringen och senaten måste resonera att spanjorerna inte har något handelsvett. De här protesterna utförs troligtvis av extremister, med uppkoppling, bandbredd och kulturkänsla, värden som i Spanien annars inte är särskilt närvarande. Parlamentariker kan man inte lita på och är förmodligen likadana. Resten av Europa reagerar ungefär lika starkt som de reagerade när Frankrike i veckan införde domstolsoberoende, godtycklig internetcensur. Och professor Ignacia Sánchez-Cuencas farhågor skulle inte kunna vara närmare att besannas. Tre dagar kvar tills den spanska demokratin går ett obehaglig öde till mötes.

I sometimes have difficulties digesting blogs about intellectual property rights. Sometimes they're completely brilliant, like Afro-IP writing about the anti-counterfeiting squad of Kenya seizing pencils for a value of $300'000. Or when IP-Tango writes about trademarks being limited to the market within which they are protected. I enjoy reading Amlan Mohantys posts on the SpicyIP India blog, like this one, on the importance of public participation in legislative debates. That touches on the subject I wrote about yesterday.

Today, however, a post on IPKitten concerns me a bit. It's about continued negotiations on border measures at the World Customs Organisation.

Some people will almost certainly remember the negotiations on SECURE Standards in WCO that collapsed in 2008. The reason was that negotiations for stricter border controls to decrease intellectual property rights infringement were discovered by developing nations who subsequently mobilised IPR experts in the organisation and created pressure for continued investigation on whether the standards were really secure, or actually necessary.

The consequence of the WCO slowing down turned into the ACTA-initiative. By collecting only a small number of like-minded nations IPR-dependent economies hoped to achieve... What?

Doctors Without Border have a campaign for access to medicines since many years. As opposed to popular belief this has very little to do with patent rights. Even though pharmaceutical patents cause quite a lot of problems on the inner European market, the medicine seizures at EU border largely rely on extraterritorial application of trademark law.

The extension of European trademark law to apply for goods that haven't entered the market makes our customs authorities assist companies with protecting their intellectual property rights on foreign markets where they might not even have registered rights. For being a region strongly opposed to expansion, the EU certianly has a very liberal view of extraterritorial application of its legislation. It's not unreasonable to ask if it's a valuable investment when the need for medicines, particularly in developing economies, is so large.

A few weeks ago I also noticed a case concerning Nokia mobile phones. Nokia is claiming in a British court that mobilephones marked Nokia, produced in China and destined for Colombia, ought to be seized and destroyed by UK customs authorities. When the country of destination is already known, you would wonder why Nokia doesn't simply protect its trademark in that country, instead of at the European border. In the event they didn't file for trademark protection in that country, that's really their fault. More than half of all Colombians are poor and I see it as a big problem that European customs authorities shall invest time and money into take away a means of relatively cheap communications technology simply because of Nokia not being bothered to get intellectual property rights protection in the end market.

In a brighter moment, I discovered that Mexico has turned into a market of pirated blu-ray and 3D DVDs! They're now sold on streets to Mexicans for affordable prices. While it might annoy J.K. Rowling, cracking down on Mexicos pirates and street salesmen would actually strike quite hard against the thousands of Mexicans that are making a living off of selling DVDs on the streets. Considering the size of the seizures of pirate copied goods in Mexico I guess it's also not unjustified to fear a huge drop in accessibility of culture and certain goods to a large part of the Mexican population.

It appears anyway as if the negotiations for IPR-related border controls have been rebooted at WCO. Multilateral fora like World Trade Organisation and WCO are more attractive for developing economies to negotiate within, since they have more control over the content and how the agreements end up being interpreted. But since I already see an extremely liberal European view of border controls applying outside Europe, I must say this concerns me a bit.

Jag har ibland svårt för bloggar som handlar om immaterialrätt. Ibland träffar de helt rätt, som när Afro-IP rapporterade att Kenyas förfalskningsenhet beslagtagit pennor till ett värde av $300.000. Eller när IP-Tango skriver om hur varumärken är är begränsade till det produktområde de är skyddade (sant! se 6§ Varumärkeslagen). Jag brukar med nöje läsa Amlan Mohantys postningar på bloggen SpicyIP India, som den här om vikten av offentlig debatt kring lagstiftning. Det berör lite ämnet jag skrev om igår.

Idag är jag dock lite bekymrad över ett inlägg på IPKitten om fortsätta förhandlingar för gränskontroller i WCO.

Vissa minns säkert förhandlingarna om SECURE Standards i World Customs Organisation som strandade 2008. Anledningen var att de förhandlingar om gränskontroller för att bekämpa immaterialrättsintrång upptäcktes av utvecklingsländer som mobiliserade experter inom organisationer och skapade tryck för att fortsätta utreda om standardena verkligen var säkra, nödvändiga och bra.

Konsekvensen av att förhandlingarna i WCO gick trögare och trögare blev ACTA-initiativet. Genom att samla enbart likasinnade länder i en liten klick kunde man nu se till att... Ja, vadå?

Läkare utan gränser har under många år haft en omfattande kampanj för att öka tillgång till mediciner för människor i utvecklingsländer. Till skillnad från vad många tror utförs de här beslagen inte på bas av patenträtt. Läkemedelspatent orsakar visserligen många problem på den inre europeiska marknaden, men i läkemedelsbeslagen lutar sig företagen, med hjälp av tullen, på varumärkesrätten.

Beslagtagningarna vid europeiska hamnar blir en sorts förlängning av europeisk lagstiftning där våra tullmyndigheter assisterar företag med immaterialrättsskydd på marknader utanför Europa. För att vara en region som kraftigt opponerar sig utvidgning har man en väldigt liberal inställning till utomterritorisk applicering av lagstiftning. Man kan fråga sig om det är en värdefull investering när behovet av mediciner, särskilt i utvecklingsländer, är så stort.

För några veckor sedan såg jag också ett fall som berörde Nokiatelefoner. Nokia hävdar i en brittisk domstol att mobiltelefoner märkta Nokia, producerade i Kina och på väg till Colombia, ska beslagtas och förstöras av Storbritanniens tullmyndighet. När destinationslandet är känt kan man undra varför Nokia inte istället skyddar sitt varumärke och sina patent på destinationsmarknaden. Jag lutar i alla fall åt att om de inte har gjort det får de skylla sig själva. Över hälften av Colombias invånare är fattiga och jag ser ett stort problem i att europeiska tullmyndigheter ska lägga pengar på att beröva colombianerna kommunikationsmöjligheter till överkomliga priser bara för att Nokia inte gitter ta ut immaterialrätter på marknader de vill kontrollera.

Några av mina ljusare stunder har jag dock upplevt i några rapporter från Mexiko. Dels har man där börjat kopiera blu-ray och 3D DVD:er och de säljs nu på på städernas gator till överkomliga priser. Det sticker möjligen i ögonen på J.K. Rowling, men hårdare tilltag mot Mexikos piratkopierar och gatuförsäljare skulle faktiskt slå ganska hårt mot flera tusen mexikaner som försörjer sig på att sälja DVD:er på gatan. Och betänker man storleken på beslagtagen av piratkopierade varor i Mexiko kan man säkerligen förvänta sig att skärpt lagstiftning minskar tillgång till kultur och dagligvaror mer än önskvärt.

Nu verkar det i alla fall som att fortsätta förhandlingar om gränskontroller har börjat få upp farten i WCO. Multilaterala forum som Världshandelsorganisationen och WCO är attraktivare för utvecklingsländer för förhandlingar, eftersom de i avtalens implementering har större makt att ställa sig emot extrema tolkningar av rikare länder. Eftersom jag redan ser tycker att tolkningarna av var europeisk lagstiftnings jurisdiktion är på tok för liberala måste jag säga att det här bekymrar mig.

Consider the possibility that European human rights policy took seriously children's suffering – their exposure, for example, to the evils of physical abuse, poverty, inadequate or absent health care, life in homes where domestic abuse is a norm, rather than an exception, or being placed in refugee camps barely distinguishable from concentration camps.

There are many of these cases. A Swedish child, looking for asylum, was refused health care last week because the Migration Office had been unclear about what rules apply to asylum seeking people and health care. The hospital won't treat him unless they're compensated. Sweden is also noted for deporting children to notorious refugee camps on Malta. More than half of Spanish children have suffered domestic abuse, and the Spanish state consistently fail in living up their obligations of human rights for refugees.

Meanwhile in the Netherlands, many young immigrants are suffering from
psychological trauma without getting help. (Really, I wonder about the coalition government partner Partij voor de Vrijheid's successes, because apparently Dutch integration is going rather well. The Swedish Democrats suggested last week that doctors should be forced to report paperless care-seeking people to authorities, to facilitate deportation. Luckily, a Swedish social liberal has, a year after the party decided to back the issue, decided to put down a motion in October 2010 for the opposite: free health care to the most exposed people.

At this point, you can imagine how Liberal party member Ullenhag's party comrade, Cecilia Malmström, has ended up in one of the most powerful institutions in Europe, in one of the administrative units with the most power to help Europeans exposed to violence. For being a long time a rather placable defender of human rights (during her career in Europarl carefully diverging too much from the views of the European Commission) and children’s rights, it is now she that is meant to drive human rights policy forward in the Union, and she who can lead her administration towards a sustainable and children-friendly policy where European children and asylum-seeking children do not get beaten up by unfriendly authorities.

Welding this power has led her to the decision to stop her engagement for human rights, instead focusing on pleasing the Council of Ministers. I get the feeling that the Swedish Liberals are afraid of challenging the authorities. Their policies are certainly more alike to Conservatism and nationalism now, than social liberalism (to which Liberaldemokraterna is a consequence). Is it possible that they would rather go with the Swedish Conservative line against health care to the paperless? The Conservatives have long been the only party in Sweden, now joined by our nationalists, to oppose free care for paperless immigrants. I sadly have doubts that the Liberals are courageous enough to stand up against the establishment. Cecilia Malmström certainly is increasing my doubts every day.

The people helping children the most are not ECPAT, Save The Children or the politicians. On the contrary they make a comfortable amount of money lobbying for internet filters.

Children's rights movements are an industry like all other industries. Unless they can show that they are doing something, they do not get their funds. Luckily, many European countries are interested in blocking hate speech sites, politically inflammatory sites, restricting blogs and limiting access to gambling sites. Or computer games. The ease with which a blocking policy for child pornography can be pushed is easy cash. And ultimately it ends up blocking access to knowledge for children, rather than protecting them.

The children instead benefit from the brave people who work with immigrants, who care for them, hide them from deportation, and bring attention to their exposed position. Not only are these organisations under-funded, they are also over-worked. You wonder who is supporting their activities. Well, not the politicians who send homosexual Iraqi couples back to Iraq or Christian Iraqis to a country where they have massacres of Christians. The Swedish government are, for some reason, supported by a ruling from the European Court of Human Rights. At least they haven't been frustrated by their own High Court going against them, as has the UK Home Office.

For inexplicable reasons, Commissioner Malmström has now suggested that children shall be granted rights they’ve already had since the year 2000. How progressive. All member states have already signed the UN protocol for children's rights with regards to trafficking and online pornography. The last signatory member state was Czech Republic who signed it in 2005. That's five years ago. This isn't a move for children’s rights, it’s a move against them. It's not a sign of progession, it's a sign of cowardice.

Since Cecilia Malmström also considers children who are engaging in begging to be trafficked, at least if these children are from Romania or Bulgaria, it’s no wonder she hasn’t protested the Nicolas Sarkoszy proposal of keeping Bulgaria and Romania out of Schengen for another four years. Romanian EU-minister Bogdan Aurescu commented on the deportations to EUObserver. I would have suspected that this is because he is a nationalist, like many other European politicians, but his conservative majority party is not. "We do not accept any restriction of freedom of movement," he said. "After 50 years of Communism, it is a very special and important right we have achieved.”

Isn't it awkward that Malmström in 2005 was convinced that Bulgaria and Romania would complete the union?

But my favourite quote is probably this Cecilia Malmström quote from March 15th 2001, from the time when she was an active parliamentarian: "Allow me to conclude by saying that the reports that will be discussed after mine show that there are also violations of human rights within the EU. Obviously we need to deal with this. If we want to be credible internally, we also need to have a sound policy externally."

Perhaps Cecilia Malmström should consider if the reverse might not be even more true.
